ANNOUNCEMENT ON THE OBLIGATIONS OF OCCUPATIONAL HEALTH AND SAFETY

With the Occupational Health and Safety Law No. 6331 published in the Official Gazette dated 30/06/2012, it has become compulsory to work with a workplace doctor and occupational safety specialist as of 01.01.2025 for all workplaces with less than 50 employees and classified as less dangerous.
In accordance with the provisions of the “ Notification on Workplace Hazard Classes Regarding Occupational Health and Safety” published in the Official Gazette dated 26.12.2012 and numbered 28509, the workplaces of Travel Agencies are also included in the scope of workplaces considered as less dangerous.
According to Article 6 of the Law, at least one occupational safety specialist and workplace doctor must be appointed in all workplaces covered by the Law, either full-time or part-time, depending on the number of employees and the hazard class of the workplace.
In the event that the workplace does not have personnel with the above qualifications, it can fulfill all or part of this service by receiving services from joint health and safety units or employee health centers (ÇASMER) or by undertaking it by itself as an employer (except for recruitment and periodic examinations and examinations) provided that it completes the trainings announced by the Ministry.
For this reason, as of 01.01.2025, it is necessary to carry out service procurement in a way to fulfill the above conditions. In the determination that this obligation is not fulfilled, it is regulated that administrative sanctions will be imposed on the workplaces with the provision 26/1-b of the Law No. 6331.
In accordance with the provisions of the legislation described above, it is important for our members to fulfill the obligations regarding their workplaces in order to avoid any administrative sanctions.
