ANNOUNCEMENT ON THE REGULATION AMENDING THE BY LAW ON TRAVEL AGENCIES

Dear Members,

The Regulation Amending the By Law on Travel Agencies was published in the Official Gazette dated July 26, 2024 and numbered 32613 as attached and entered into force. With the amendment, the following sentences have been added to the third paragraph of Article 17 of the Regulation on Travel Agencies

“The travel agency is obliged to verify the document numbers of the accommodation facilities within the scope of the Tourism Incentive Law No. 2634 dated 12/3/1982 and the Law No. 2634 on Tourism Incentive Law and the Law No. 7464 dated 25/10/2023 on the Leasing of Houses for Tourism Purposes and Amendments to Certain Laws, through the Ministry's database and include them in its sales and marketing activities. Travel agencies cannot carry out marketing and sales of accommodation facilities and residences without a certificate.”

With this provision, travel agencies are required to indicate the certificate numbers of certified residences in the Ministry's database in their sales and marketing activities.

Article 27, paragraph four of the Law No. 1618 on Travel Agencies and the Association of Travel Agencies states that “Travel agencies that do not comply with the provisions of this Law, except for the acts specified in this article, are warned by the Ministry to correct the situation or not to act contrary to the legislation again. If the necessary corrections are not made within thirty days despite the warning or if the same or other acts or acts requiring warning are detected within one year, one thousand New Turkish Lira.” Travel agencies that act contrary to the provision of the Regulation added in accordance with the provision may be subject to administrative sanctions.
